The juvenile convict in the Delhi gang rape case becomes free today since the Delhi High Court refused to stop his release from observation home.
A Division Bench of High Court, comprising Chief Justice G.Rohini and Justice Jayant Nath has observed that the Court cannot stay the juvenile’s release according to the existing law. The Division Bench directed the Juvenile Justice (JJ) to make a plan, after interacting with the convict’s parents and guardians, for his post-release rehabilitation and “social mainstreaming”.
BJP leader Subramanian Swami & the victim’s parents had approached the High Court to stop the juvenile’s release on his completing the three- year sentence. Central Government also had supported them and wanted to prolong the convict’s stay in the observation home.
Expressing her disappointment on the Court order, Asha Devi, the victim’s mother has responded as ‘crime has won & we have lost’.” Despite all our efforts for three years, our government & our courts have released a criminal. The assurance we were given that we would get justice has not been delivered. The fight is not over. We are shattered. Today, a criminal has been set free despite all our efforts. We hear that he will be monitored by a committee for the next 2 years,” she said.
The victim’s father has also responded with deep sorrow. “We are not bigger than the court. The order has been issued. There is nothing we can do now. Our fight is a larger one to ensure that the crime of rape is done away with in society. Our fight is not over yet. 2012 has changed us forever. I can’t eat, sleep or go on living like before. This crime has changed my family & me forever, “he said.
